Mediavine Programmatic Advertising (Ver 1.1)

The Website works with Mediavine to manage third-party interest-based advertising appearing on the Website. Mediavine serves content and advertisements when you visit the Website, which may use first and third-party cookies. A cookie is a small text file which is sent to your computer or mobile device (referred to in this policy as a “device”) by the web server so that a website can remember some information about your browsing activity on the Website.

First party cookies are created by the website that you are visiting. Powwows.com, LLC (“PowWows.com,” “we,” “us,” or “our”) operates www.powwows.com, our merchandise store at shop.powwows.com, our discussion forum, our email newsletters, and our social media pages (collectively, the “Services”).

This Privacy Policy explains what information we collect, how we use it, who we share it with, and the choices and rights you have.

If you read only one section, read Section 2 — Advertising, Analytics, and Tracking Technologies. That is where we name the third-party tools that collect information about you when you visit our site.


1. Information We Collect

Information you give us directly

  • Contact information — your name and email address when you subscribe to a newsletter, and your name, email address, and any other details you include when you contact us.
  • Order information — items purchased, shipping name and address, and order history when you buy from shop.powwows.com. Payment card details are collected and processed directly by Shopify Payments and PayPal; we do not receive or store full payment card numbers.
  • Event listing information — details you submit when you add a pow wow, vendor, or event listing, including organizer contact information.
  • Forum content — your username, posts, and any information you include in them. Our forum remains available to read and to existing members, but is closed to new registrations.
  • Contest and giveaway entries — the information requested on the entry form for each promotion, which may include your name, email address, and mailing address for prize fulfillment.
  • Submitted media — photos, videos, and other content you send us for publication.

Information collected automatically

When you visit our Services, we and our third-party partners automatically collect:

  • IP address and approximate geographic location derived from it
  • Device type, operating system, and version
  • Browser type, version, and language settings
  • Pages viewed, links clicked, time spent on pages, and scroll depth
  • Video content viewed or played on our Services
  • Referring URL and exit pages
  • Search terms entered on our site
  • Cookie identifiers, advertising identifiers, and similar identifiers
  • Email address in hashed (pseudonymized) form, where provided to advertising partners

Information we receive from third parties

  • Advertising and analytics partners provide aggregated audience, demographic, and interest information about our visitors.
  • Facebook, Instagram, YouTube, and other social platforms provide information about interactions with our pages and content, subject to your settings on those platforms.
  • Kit (our email platform) and Shopify (our store platform) provide subscriber, order, delivery, open, and click data.

2. Advertising, Analytics, and Tracking Technologies

We use cookies, pixels, tags, web beacons, and similar technologies (collectively, “Tracking Technologies”) on our Services. Some are necessary to operate the site; others support analytics and advertising.

Your choices. We use a consent management platform (CookieYes) to give you control over non-essential Tracking Technologies. When you first visit our Services, you will see a cookie banner allowing you to accept or reject categories of cookies. You can change your choices at any time using the Cookie Settings link in our footer. Cookies classified as strictly necessary are required to operate the site and cannot be disabled.

The specific third-party Tracking Technologies we use are as follows.

Meta Pixel (Facebook and Instagram)

We use the Meta Pixel, provided by Meta Platforms, Inc. (“Meta”), on www.powwows.com and shop.powwows.com. When the Meta Pixel loads, it may collect and transmit to Meta:

  • Your IP address
  • Browser, device, and operating system information
  • The URLs and pages you view on our Services
  • The referring URL that brought you to our site
  • Actions you take on our Services, including page views, content views, video plays, newsletter signups, add-to-cart events, checkout initiation, and completed purchases
  • Cookie identifiers set by Meta, including the _fbp cookie
  • Your email address in hashed form, in some cases, for advertising match purposes

If you are logged into Facebook or Instagram when you visit us, Meta may link this activity to your Meta account.

We use the Meta Pixel to measure the performance of our advertising, to build custom and lookalike audiences, and to show you advertisements for PowWows.com content, events, products, and services on Meta’s platforms. Meta processes this information as an independent controller for its own purposes, as described in Meta’s Privacy Policy (https://www.facebook.com/privacy/policy) and Cookies Policy (https://www.facebook.com/policies/cookies).

Mediavine Programmatic Advertising

We work with Mediavine to manage third-party interest-based advertising on our Services. Mediavine and its partners use first-party and third-party cookies, tags, pixels, and beacons to serve and measure advertising.

Data collected for personalized advertising through Mediavine includes IP address, operating system type and version, device type, website language, browser type, and email address in hashed form. Mediavine partners may combine this with information they collect independently — including advertising IDs, pixel data, usage data, device information, geolocation data, traffic data, and referral source — and may create unique IDs to build audience segments for targeted advertising across devices, browsers, and apps.

If you opt out of personalized advertising, you will still see advertisements on our Services, but they will not be selected based on your interests.

Google Analytics 4

We use Google Analytics 4, provided by Google LLC, to understand how visitors use our Services. Google Analytics uses cookies and similar technologies to collect information including your IP address, pages viewed, session duration, device and browser information, and referral source.

We have enabled Demographics and Interests Reporting and Google Signals. This means Google may supplement our analytics data with age range, gender, and interest category information derived from your Google account and activity across Google’s services and partner sites, and may associate your activity on our Services with your signed-in Google account across devices.

Your controls: Manage your Google ad settings and turn off ads personalization at https://adssettings.google.com. Install the Google Analytics Opt-Out Browser Add-on at https://tools.google.com/dlpage/gaoptout.

Kit (formerly ConvertKit)

We use Kit for our email newsletters, and the Kit WordPress plugin runs on our site. Kit sets cookies to recognize returning subscribers, to display or suppress signup forms, and to attribute newsletter signups and link clicks to the pages you visited. If you subscribe or click a link in one of our emails, Kit may associate your browsing activity on our Services with your subscriber record.

Shopify

Our merchandise store at shop.powwows.com runs on Shopify. Shopify sets cookies necessary for cart, checkout, and fraud prevention, and provides us with store analytics. Payment processing is handled by Shopify Payments and PayPal, each under their own privacy policies.

YouTube, Facebook, and Restream

Our Services include embedded YouTube videos, embedded Facebook content, and live streams delivered through Restream.io. These embeds set cookies and collect information about your interaction with them, including which videos you play, even if you do not click on them. See Section 5.

Amazon Associates and other affiliate links

We participate in the Amazon Services LLC Associates Program, an affiliate advertising program that allows us to earn fees by linking to Amazon.com and affiliated sites. Many links on PowWows.com are affiliate links. At no cost to you, we may earn a commission when you purchase through them. Affiliate programs use cookies and referral identifiers to attribute purchases to our site.

How to control Tracking Technologies

  • Our cookie banner. Use the banner shown on your first visit, or the Cookie Settings link in our footer at any time, to accept or reject advertising, analytics, and functional cookies.
  • Your browser. Most browsers let you block or delete cookies, and block third-party cookies specifically, through their privacy settings. Blocking cookies may cause parts of our Services to stop working properly.
  • Industry opt-outs. Digital Advertising Alliance at https://optout.aboutads.info, Network Advertising Initiative at https://optout.networkadvertising.org, and the AppChoices mobile app at https://youradchoices.com/appchoices.
  • Your mobile device. Use “Limit Ad Tracking” (iOS) or “Opt out of Ads Personalization” (Android).
  • Contact us. Email webmaster@powwows.com with the subject line “Do Not Sell or Share” and we will process your request as described in Section 6.

Do Not Track and Global Privacy Control

Our Services do not respond to Do Not Track (“DNT”) browser signals, because no common industry standard for DNT has been adopted.

[VERIFY once configured — publish only if true:] We honor the Global Privacy Control (“GPC”) signal. When our consent management platform detects a GPC signal from your browser, we treat it as a request to opt out of the sale or sharing of your personal information and of targeted advertising, and we apply that preference automatically without any further action from you.

Consent records

We keep a record of your consent choices, including the date, the categories you accepted or rejected, and a consent identifier, so that we can demonstrate that your preferences were captured and honored.


3. How We Use Your Information

We use the information we collect to:

  • Operate, maintain, and improve our Services
  • Publish and maintain our pow wow event calendar and vendor listings
  • Process and fulfill your merchandise orders
  • Deliver our newsletters and respond to your inquiries
  • Personalize content, event listings, and product recommendations
  • Administer contests, giveaways, and promotions
  • Measure and improve the performance of our content and advertising
  • Serve and measure interest-based advertising on our Services and on third-party platforms
  • Detect, investigate, and prevent fraud, abuse, and security incidents
  • Comply with legal obligations and enforce our policies

4. How We Share Your Information

We share personal information with the following categories of recipients:

  • Service providers who host our site, deliver our email, process payments, fulfill merchandise orders, and provide analytics, under contracts requiring them to protect the information. These include Kit, Shopify, Shopify Payments, PayPal, Google, and Restream.
  • Advertising and analytics partners, as described in Section 2. Under some state privacy laws, this is considered a “sale” or “sharing” of personal information, or “targeted advertising,” even though we receive no money in exchange for it.
  • Affiliate program operators, when you click an affiliate link.
  • Legal and safety recipients, when we believe disclosure is necessary to comply with law, respond to legal process, enforce our policies, or protect the rights, property, or safety of PowWows.com, our users, or the public.
  • Business transfers, in connection with a merger, acquisition, financing, or sale of assets.

We do not sell your personal information for money, and we do not rent, share, or provide our email list to advertisers or sponsors. Sponsored newsletter sends are created and sent by us; sponsors never receive your email address or subscriber information. All sponsored content is labeled as sponsored.

We do disclose personal information to advertising partners in ways that qualify as a “sale” or “sharing” under California and other state laws. You can opt out — see Section 6.

Note on our Circle community: our membership community is hosted on Circle, a separate platform with its own privacy policy and terms. Information you provide to Circle is governed by Circle’s privacy policy in addition to this one.


5. Video Content

Our Services include embedded YouTube videos, embedded Facebook video, and live streams from pow wow events delivered through Restream.io, YouTube, and Facebook.

When you view or interact with video content on our Services, information about that activity — including which videos you viewed and identifiers associated with your browser or device — may be collected by YouTube (Google), Meta, Restream, and our analytics and advertising partners.

By using our Services, you consent to the disclosure of your video viewing activity to these partners in connection with advertising and analytics. This consent is given separately and unambiguously from any other agreement, is valid for the period during which you use our Services, and may be withdrawn at any time by rejecting advertising and analytics cookies through the Cookie Settings link in our footer, by using the industry opt-outs in Section 2, or by emailing us at webmaster@powwows.com.


6. Your Privacy Rights

Rights available to residents of certain U.S. states

Depending on where you live, you may have the right to:

  • Know and access the categories and specific pieces of personal information we have collected about you, the sources, our purposes, and the categories of third parties we disclose it to
  • Correct inaccurate personal information
  • Delete personal information we have collected from you
  • Obtain a portable copy of your personal information
  • Opt out of the sale or sharing of your personal information and of targeted advertising
  • Limit the use of sensitive personal information, where applicable
  • Not be discriminated against for exercising any of these rights
  • Appeal a denial of your request

These rights currently apply to residents of California, Colorado, Connecticut, Virginia, Utah, Texas, Oregon, Montana, Delaware, Iowa, Nebraska, New Hampshire, New Jersey, Minnesota, Tennessee, Maryland, Indiana, Kentucky, Rhode Island, and other states as their privacy laws take effect. We extend these rights to all U.S. visitors regardless of state.

We will verify your identity before acting on access, correction, deletion, or portability requests, typically by confirming control of the email address associated with your information. We will respond within 45 days and may extend once by an additional 45 days with notice to you. Opt-out requests do not require verification.

An authorized agent may submit a request on your behalf with written proof of authorization.

If you are in the European Economic Area or United Kingdom

Where the GDPR or UK GDPR applies, our legal bases for processing are: performance of a contract (order fulfillment), legitimate interests (site security, analytics, and direct communication with our audience), consent (newsletter subscriptions), and legal obligation.

You have the right to access, rectify, erase, restrict, and port your personal information, to object to processing based on legitimate interests, and to withdraw consent at any time. You may lodge a complaint with your local supervisory authority.

Where we transfer personal information to the United States, we rely on Standard Contractual Clauses or another approved transfer mechanism through our service providers.


7. Email Communications

We collect your email address to send you newsletters, pow wow and event updates, responses to your inquiries, order confirmations and shipping updates, and information about our products and services.

Our newsletters include advertising, and some sends are sponsored. Sponsored content is labeled. We create and send all sponsored messages ourselves; sponsors do not receive your email address or any subscriber information.

In accordance with the CAN-SPAM Act, we do not use false or misleading subject lines or sender addresses, we identify advertising content as such, we include our physical mailing address in commercial emails, and we honor unsubscribe requests promptly.

You can unsubscribe at any time using the link at the bottom of any email, or by emailing webmaster@powwows.com. Transactional messages about an order you placed may still be sent after you unsubscribe from marketing email.


8. Children’s Privacy

Our Services are intended for a general audience and are not directed to children under 13. We do not knowingly collect personal information from children under 13. If we learn that we have collected such information, we will delete it.

We do not knowingly sell or share the personal information of consumers under 16 years of age without the affirmative authorization required by California law.


9. Data Retention

We retain personal information for as long as needed to provide the Services and for the purposes described in this policy.

  • Newsletter subscribers — retained while you are subscribed. When you unsubscribe, Kit retains your record on a suppression list so that we do not email you again.
  • Order records — retained as required for tax, accounting, and customer service purposes.
  • Forum accounts and posts — retained while the forum remains available.
  • Event listings — retained indefinitely as part of our historical pow wow archive.
  • Analytics and advertising data — retained according to the retention settings of each platform. Google Analytics applies its own retention limits.

10. Security

We use commercially reasonable measures to protect personal information, including encrypted connections (HTTPS/TLS) across our Services, access controls limiting personal information to the small number of people who need it, regular malware scanning, and reputable third-party providers for payment and order processing.

Payment transactions are processed by Shopify Payments and PayPal and are not stored on our servers. We never ask for credit card numbers by email.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

If a data breach affecting your personal information occurs, we will notify you by email and by notice on our Services, without unreasonable delay and consistent with applicable law.


11. Third-Party Links and Services

Our Services contain links to third-party websites, including pow wow organizer sites, vendor sites, affiliate merchants, and social media platforms. These sites have their own privacy policies and we are not responsible for their content or practices. We encourage you to read the privacy policy of any site you visit.


12. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the “Last Updated” date at the top of this page. If we make material changes, we will provide additional notice by email or by a prominent notice on our Services.
